Kochi Tuskers Kerala have appealed against the Bombay High Court’s decision to reject their case to restrain the BCCI from cashing its bank guarantee of 156 crore rupees. The franchise’s case was denied by a single bench of Justice SF Vajifdar on Wednesday and a new hearing before a division bench of the court has been set for Thursday morning, a Kochi official told ESPNcricinfo.”There is a hearing at 11 am tomorrow before a division bench,” Mukesh Patel, managing director, Parinee Developers Pvt Ltd, and one of the owners of the team, said. Kochi is also seeking a stay on the board’s decision to terminate the franchise and wants the court to refer the dispute to an arbitrator under the arbitration clause in their franchise agreement.Kochi is the third franchise to be expelled from the league over the last 12 months by the BCCI. Last year Rajasthan Royals and Kings XI Punjab, the two franchises that were terminated in October 2010, not only succeeded in having their cases referred to an arbitrator, but the court also returned them to the league and allowed them to compete in the IPL 2011.The BCCI had axed Kochi from the IPL for breaching its terms of agreement, the new board president N Srinivasan said, after the annual general meeting in Mumbai on September 19. The trigger for the decision was the franchise’s inability to furnish a new bank guarantee for 2011. It is understood that the deadline for Kochi to submit the bank guarantee was March 26, 2011. Therefore the BCCI felt it had every right to terminate the contract once the franchise had failed to produce it.Patel, however, denied that the franchise owed the board any money. “The BCCI notice is wrong, prima facie,” he said. “We have never defaulted. The BCCI will be paying us 12 to 15 crore rupees ($2.5 million to $3.13 million) next month as a part of our central revenue.”The franchise’s dispute centres on the BCCI’s decision to reduce the number of IPL games from 94 to 74. “The number of games in Tender Document was 94; they then reduced it to 74 but did not reduce the franchise fees.”Srinivasan, however, had said that the decision to remove Kochi from the league was final and termed their alleged transgression an “irremediable breach”.

The move is not about youth – the three men are aged 28, 29 and 30 respectively – but filling specific gaps that the Warriors coach Mickey Arthur outlined last month in an interview with ESPNcricinfo.Arthur wanted a fast bowler to boost the attack and settled on Cameron, from New South Wales, along with Rimmington, from Queensland. Cameron played for Australia A last summer but injuries have limited him to 16 first-class appearances in nine seasons, and with the younger Patrick Cummins and Mitchell Starc competing for positions, he faced a challenge to hold his spot with the Blues.Rimmington has been a solid performer for the Bulls, but was viewed as more of a limited-overs specialist and had managed only nine first-class games in six seasons at Queensland. Arthur said the two men would add plenty to a Western Australia attack that had lost the experience of Ashley Noffke and Brett Dorey during the previous summer.”Nathan brings the ability to bowl at the death in one-day cricket, which is an area where we have been deficient,” Arthur said. “He offers a great deal of experience and is a tough character, someone who brings a great deal to the squad.”Mark bowls with incredible pace, and we have lacked that quality in recent years. He is an outstanding strike bowler and a genuine match winner when he is on the field. It is a fact that Mark has battled injuries in recent seasons, but we will manage his program carefully to ensure we get maximum impact from him when he takes the field next summer.”Arthur also spoke last month of searching for a wicketkeeper-batsman, and while Birt is far from a full-time gloveman, he has stepped into the role at times for Tasmania in the past few seasons. He is another man whose first-class chances have been limited recently – he played five Sheffield Shield games last season – but he has also played three Twenty20s for Australia.”In Travis we have filled a position available for an experienced batsman,” Arthur said. “He is an exceptional one-day player and also has a good track record in first-class cricket. He will add depth to our batting and create healthy competition for spots in the top six.”Birt and Rimmington have each signed on for two years, while the older Cameron has settled for a one-year deal. Meanwhile, Tasmania have secured the fast bowler Jackson Bird, 24, a Sydney grade cricketer who couldn’t force his way into the New South Wales side. All six states are finalising their playing lists for 2011-12, with full squads expected to be released in the next few weeks.

Gautam Gambhir has rubbished claims he covered up a shoulder injury to play in the IPL, saying he did play with discomfort in his right shoulder but was never aware of the extent of the problem. Gambhir said he had felt the discomfort during the World Cup final but as it wasn’t too painful he didn’t think it was a major injury, and hence played the IPL, in which he captained Kolkata Knight Riders. Gambhir could now miss India’s tour of the West Indies, where he was to captain the side during the limited-overs leg, but insists he never put his franchise before playing for India and would not have risked worsening his injury had he known its nature.”Any modern cricketer knows that by feigning or risking injury he is only jeopardising his own career,” Gambhir told the . “It is imaginative to say I was covering my injury to play in the IPL. I played with discomfort without realising the gravity of my injury. As a leader, my team needed me, but to say I preferred club over country is ridiculous.”On Wednesday, Kolkata’s team trainer Andrew Leipus wrote a letter to the BCCI saying Gambhir had complained of a sore shoulder when he arrived in Kolkata for the IPL and subsequent scans had shown a serious injury that would require four to six weeks to heal. The letter said Gambhir recalled landing on his arm during the World Cup final and feeling acute pain. Gambhir said he did not think it was a major injury at the time.”I felt some discomfort during the World Cup final, while running between the wickets. Gerry Alexander, the former West Indies captain, has died at the age of 82 in Jamaica.Alexander was a wicketkeeper-batsman who represented West Indies in 25 Tests in a five-year career that began in 1957. He led the side in 18 of those matches, beginning with a home series against Pakistan in 1958 and stepping down after England’s visit in 1960.”He [Alexander] was a stalwart in Jamaica and West Indies cricket and made a tremendous contribution to the game as captain and a player on the field. He was an inspiration to many people off the field as well,” Julian Hunte, the WICB president, said. “He displayed a true love and passion for West Indies cricket and gave his all for the good of the game. He was a dignified and reliable leader of the West Indies team and a committed supporter of the game at all levels. He excelled in the 1960-61 Tied Test Series in Australia and will always be remembered for the fantastic role he played to help ‘save Test cricket’.”At a time when the West Indies and the world beyond it were undergoing great social change, Alexander was the last white captain of the team. He was replaced first temporarily and then permanently by Frank Worrell in time for the legendary 1960-61 series in Australia, which featured Test cricket’s first tie at Brisbane.Prior to that he courted controversy by choosing to send home the fast bowler Roy Gilchrist from the West Indies’ 1958-59 tour of India and Pakistan for reasons of indiscipline, including the bowling of repeated beamers.
